Mediation
Mediation is a process whereby a neutral and
impartial third person (Brainville, Inc.) facilitates the resolution of a
dispute without prescribing what it should be.
It is an informal and non-adversarial process intended to help disputing
parties reach a mutually acceptable agreement, without the need for costly
litigation.
Brainville, Inc.’s certified mediation
staff has met the training, education and mentorship requirements mandated by
the Florida Supreme Court.
We work with utilities and software
developers to reduce obstacles to communication, assist in the identification of
issues and the exploration of alternatives, and otherwise encourage voluntary
agreements to resolve implementation problems. Brainville, Inc. has extensive
experience in the utility and software industry uniquely qualifying them to
effectively communicate with utilities and vendors to ensure the needs and the
interests of both parties are represented in a fair and balanced manner. The
ultimate decision-making authority, however, rests solely with the parties.
During mediation clients are encouraged to
fully disclose their position to Brainville, Inc. to facilitate the problem
solving process knowing that Brainville, Inc. is required to maintain the
confidentiality of all information revealed during mediation except where
disclosure is required or permitted by law or is agreed to by all parties.
Consistent with mediator standards of
impartiality and preserving party self‑determination, Brainville, Inc. may
provide information during the process that has been gleaned from our expertise
in the utility software industry. If
Brainville, Inc. believes that a party does not understand how an agreement may
adversely affect legal rights or obligations we may advise that party to consult
with legal counsel.
